Terms of service
You don't need to rewrite the whole Terms. Shopify's template is fine as a base. Six sections need to change, though, because they conflict with your new refund policy, assume a US store, or still have placeholders. Replace only these sections and leave the rest exactly as it is, especially Section 9, Relationship with Shopify, which Shopify says must not be changed.
Overview:
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. YOSHAM reserves the right to accept or decline your order for any reason at its discretion. Your order is accepted when we confirm it. For prepaid orders, we must receive your payment first. For Cash on Delivery orders, payment is due when the order is delivered. You can cancel an order for a full refund any time before it ships. Once it has shipped, it can't be cancelled. If we do not accept, change or cancel an order, we will try to let you know using the email, billing address or phone number you gave when you ordered, and we will refund any amount you have already paid.
Returns, replacements and refunds are handled only as described in our Refund Policy.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice. You pay the price shown when you place your order, as set out in your order confirmation. Prices shown include GST. Shipping charges, if any, are shown at checkout before you pay.
Prices in our online store may differ from prices in physical stores or on other websites and marketplaces. From time to time we may run promotions that have their own terms. If those terms conflict with these Terms, the promotion terms apply.
You agree to give us current, complete and accurate purchase, payment and contact information, and to keep it up to date, so that we can complete your order and contact you when needed.
You confirm that (i) the payment details you provide (card, UPI, net banking, wallet or other method) are correct and complete, (ii) you are authorised to use that payment method, and (iii) you will pay all charges for your order at the prices shown, including shipping and applicable taxes. For Cash on Delivery orders, you agree to pay the full order amount when the order is delivered.
SECTION 5 - SHIPPING AND DELIVERY
All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by courier partners or events outside our control.
If your order is not delivered (for example, if it is lost in transit or returned to us by the courier), you will receive a 100% refund of the amount you paid, including shipping, or we will send the order again at no extra cost, as described in our Refund Policy. Once your order is delivered, risk of loss passes to you.
SECTION 6 - INTELLECTUAL PROPERTY:
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of them, are owned by YOSHAM, its affiliates or licensors and are protected by the copyright, trademark and other intellectual property laws of India and other countries.
SECTION 22 - GOVERNING LAW
These Terms of Service, and any separate agreements under which we provide Services to you, are governed by the laws of India. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts at Surat, Gujarat, India.
